1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the GLP-1 Wellness Program telephone service, the movu.fit website, and any SMS messages sent by us (collectively, the "Service"). By calling our toll-free number, using our website, or receiving messages from us, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
The Service is available only to individuals who are at least 18 years of age and reside in the United States. By using the Service, you represent and warrant that you meet these requirements. Our AI assistant will verify your age during the call. If you indicate you are under 18, the call will conclude and no SMS will be sent.
3. Description of Service
The GLP-1 Wellness Program provides an inbound telephone qualification and health referral service. When you call our toll-free number, an AI assistant will:
- Disclose that it is an artificial intelligence within the first 10 seconds of the call.
- Ask a small number of screening questions to determine whether you may be a candidate for a GLP-1 physician consultation.
- With your explicit verbal consent, send SMS messages to the phone number you called from, containing links to schedule a free consultation with a licensed physician and information about related health and wellness products and services.
The Service is a referral and information service only. We do not provide medical advice, diagnose conditions, prescribe medications, or practice medicine in any form.
4. Not Medical Advice
Important: Nothing provided through this Service constitutes medical advice, diagnosis, or treatment. The information shared during calls and in SMS messages is for general informational purposes only. Always consult a licensed healthcare provider for medical decisions. The physicians you may be referred to through this Service are independent practitioners and are not employed by or affiliated with us.
5. AI-Powered Calls
You acknowledge and agree that when you call our toll-free number, you will interact with an AI-powered voice assistant, not a human agent. The AI assistant is designed to conduct a brief qualification conversation and, with your consent, facilitate the delivery of an SMS.
The AI assistant will clearly identify itself as artificial intelligence at the beginning of each call. All calls are recorded for quality assurance and compliance purposes.
6. SMS Messaging Terms
- Consent: You will only receive SMS messages from us if you provide clear verbal consent during your call. By consenting, you agree to receive messages about your consultation and related health and wellness products and services, including but not limited to hormone therapy (TRT, HRT), hair restoration, skincare, and wellness supplements. Consent is not a condition of any purchase or service.
- Frequency: Message frequency varies. You will receive an initial message immediately, and may receive additional messages periodically about related health and wellness offerings.
- Content: Messages may contain links to schedule physician consultations or learn about health and wellness products and services.
- Opt-out: Reply STOP to any message to unsubscribe. You will receive a confirmation and no further messages.
- Help: Reply HELP for customer support information.
- Carriers: Compatible with all major U.S. carriers. Message and data rates may apply based on your mobile plan.
- Liability: We are not responsible for delayed or undelivered messages caused by carrier issues, device incompatibility, or network outages.
7. Call Recording
By using the Service, you consent to the recording of your telephone call. Call recordings are used for consent verification, quality assurance, regulatory compliance, and dispute resolution. Recordings are stored securely and retained in accordance with our Privacy Policy.
8. No Guarantees or Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
- You will qualify for a GLP-1 consultation.
- Any physician consultation will result in a prescription or treatment plan.
- Any treatment will produce specific health outcomes.
- The Service will be uninterrupted, error-free, or available at all times.
9. Limitation of Liability
To the fullest extent permitted by applicable law, the GLP-1 Wellness Program, its operators, affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service, regardless of the cause of action or the theory of liability.
Our total aggregate liability arising from or related to the Service shall not exceed fifty dollars ($50.00).
10. Indemnification
You agree to indemnify, defend, and hold harmless the GLP-1 Wellness Program, its operators, affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Third-Party Services
The Service may contain links to third-party websites or services, including physician consultation booking platforms. We are not responsible for the content, privacy practices, or terms of any third-party services. Your interactions with third-party providers are governed solely by their respective terms and policies.
The physicians accessible through the booking link are independent licensed practitioners. We do not employ, supervise, or control them, and we assume no responsibility for the care they provide.
12. Intellectual Property
All content, trademarks, logos, and materials associated with the Service are the property of the GLP-1 Wellness Program or its licensors. You may not reproduce, distribute, or create derivative works from any Service content without our prior written consent.
13. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose.
- Misrepresent your identity or eligibility during a call.
- Attempt to interfere with, disrupt, or reverse-engineer any aspect of the Service.
- Use automated systems to place calls to the Service (our toll-free number is for individual consumer use only).
- Record calls without disclosing such recording to us, where required by law.
14. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except that either party may bring an individual action in small claims court if the claim qualifies.
Class Action Waiver: You agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class action, collective action, or representative action. You waive any right to participate in a class, collective, or representative proceeding.
Opt-out: You may opt out of this arbitration provision by sending written notice to compliance@movu.fit within 30 days of first using the Service. The notice must include your name, phone number, and a clear statement that you wish to opt out of arbitration.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. If arbitration does not apply, the exclusive jurisdiction and venue for any legal proceedings shall be the state and federal courts located in New Castle County, Delaware.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
17. Changes to These Terms
We may modify these Terms at any time. The "Last Updated" date at the top of this page reflects the most recent revision. Your continued use of the Service after any modification constitutes acceptance of the updated Terms.
